These Terms of Service and Recurring Service Agreement (“Terms”) govern your access to and use of the website https://www.clearwater.today/ (“Website”) and the residential pool cleaning, maintenance, chemical balancing, inspection, minor repair, storm recovery, and related services (“Services”) provided by Clear Water Solutions Pool Service (“Company,” “we,” “us,” or “our”).

By accessing or using the Website or Services, including requesting service, scheduling, enrolling in recurring services, or submitting payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Website or Services.
1. Scope of Services
Clear Water Solutions Pool Service provides residential pool cleaning, routine maintenance, water testing, chemical balancing, inspection, minor repairs, and related services. Services may be provided on a one-time or recurring basis.
All quotes provided via the Website, email, text message, or phone are estimates only and may be adjusted based on pool size, condition, equipment type, accessibility, chemical demand, or unforeseen conditions discovered during service.
2. Recurring Service Agreement
By enrolling in recurring service, you agree to the following:
2.1 Term & Renewal
Recurring services are provided on a month-to-month basis and automatically renew unless canceled in accordance with these Terms.
2.2 Service Frequency & Scheduling
Services are performed according to the selected schedule (weekly, bi-weekly, or monthly). Specific service days are not guaranteed and may be adjusted due to holidays, weather, route optimization, staffing availability, or operational needs.
2.3 Holiday Closures
The Company observes the following holidays and does not perform services on these days:

2.4 Monthly Visit Structure
Recurring service pricing is based on four (4) service visits per month. Some calendar months include five (5) service weeks. Customers are not charged extra for a fifth service week. Any additional service week is treated as scheduled time off and does not result in service credits, refunds, or discounts.
2.5 Customer Responsibilities
Customers agree to:

Provide safe, unobstructed access to the pool and equipment, including unlocked gates

Secure pets and maintain a safe working environment

Disclose known pool issues, equipment malfunctions, leaks, algae conditions, or prior damage
The Company is not responsible for injury, delay, or damage resulting from unsafe conditions, restricted access, pets, landscaping hazards, or failure to disclose known issues.
2.6 Pool Condition & Additional Services
If pool conditions require labor, chemicals, or services beyond routine maintenance, additional services may be recommended and performed only with customer authorization. Additional fees may apply.
3. Pricing, Payment, and Fees
3.1 Billing & Payment Terms
All recurring service invoices are billed at the beginning of each month and are due on or before the 1st day of the service month. Payment is required for services to be rendered.
3.2 Accepted Forms of Payment
The Company accepts credit cards, debit cards, checks, and approved electronic payment methods.
3.3 Credit & Debit Card Processing Fees
Payments made by credit or debit card are subject to an additional processing fee, which represents the cost charged to the Company by the payment processor. This fee will be disclosed prior to payment and reflected on the invoice or receipt.
By choosing to pay by credit or debit card, you authorize Clear Water Solutions Pool Service to charge the applicable processing fee in addition to the service amount.
3.4 Late Fees
Payments not received within ten (10) days of the due date may incur a $20 late fee. Continued non-payment may result in suspension or termination of services.
3.5 Returned or Failed Payments
Returned checks, declined transactions, or failed electronic payments are subject to a $35 fee and may result in service interruption until payment is resolved.
3.6 Price Adjustments
Service pricing may be adjusted due to increases in chemical costs, fuel prices, insurance premiums, labor expenses, or changes in service scope. Customers will receive at least thirty (30) days’ notice of pricing changes.
4. Cancellations & Termination
4.1 Customer Cancellation
Customers may cancel recurring services with seven (7) days’ written notice. Cancellation does not waive payment obligations for services already rendered or billed.
4.2 Company Termination
The Company may suspend or terminate services for reasons including, but not limited to:

Non-payment or repeated late payment

Unsafe or hazardous conditions

Repeated access issues
-
Misrepresentation of pool condition

Violation of these Terms

Abusive, threatening, or unlawful behavior
5. Weather, Safety & Service Interruptions
For the safety of service technicians, services may be limited, delayed, rescheduled, or not performed due to inclement weather, storms, flooding, lightning, high winds, extreme heat, hazardous conditions, or any circumstance deemed unsafe by the Company.

Missed or delayed services due to these conditions or other events beyond the Company’s control do not constitute a breach of contract and do not result in credits, refunds, or service extensions.
6. Storm & Hurricane Services (Florida-Specific)
Due to Florida’s susceptibility to tropical storms and hurricanes, routine maintenance services do not include storm-related cleanup or recovery.

Additional services such as debris removal, algae treatment, chemical rebalancing, drain-downs, emergency cleanups, or post-storm recovery may be required and will incur additional storm recovery charges based on labor, chemicals, materials, and time required.

The Company is not responsible for storm-related damage to pools, equipment, screens, cages, decks, or surrounding property.

7. No Guarantees / Disclaimer of Warranties
Services are provided “as is” and “as available.” The Company makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

No guarantees are made regarding water clarity, chemical balance, algae prevention, equipment performance, or longevity of pool surfaces or components.
8. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or special damages.

The Company’s total liability shall be limited to the amount paid for the specific service giving rise to the claim.
9. Repairs & Recommendations
The Company may recommend repairs, replacements, or upgrades. Customer approval is required before performing services beyond routine maintenance.
The Company is not responsible for manufacturer defects, warranty claims, or third-party repairs.
10. Intellectual Property & Website Use
All Website content, including text, images, graphics, logos, and design elements, is owned by or licensed to Clear Water Solutions Pool Service. Unauthorized use, reproduction, scraping, or disruption of the Website is prohibited.
11. Privacy & Data Use
Use of the Website and customer information is governed by the Company’s Privacy Policy. Customer data is used solely for billing, scheduling, service delivery, and customer communication.
12. Indemnification
You agree to indemnify and hold harmless Clear Water Solutions Pool Service, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from your breach of these Terms, unsafe property conditions, or misuse of the Website or Services.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Florida. Any legal action shall be brought exclusively in Florida state or federal courts.
14. Changes to Terms
The Company reserves the right to update these Terms at any time. Continued use of the Website or Services constitutes acceptance of any revised Terms.
15. Entire Agreement
These Terms constitute the entire agreement between you and Clear Water Solutions Pool Service and supersede all prior agreements or understandings, whether written or oral.
